1. Acceptance of Terms

By downloading, installing, or using YearOn! Challenge Planner ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a binding agreement between you and Redbud Works LLC ("Company", "we", "us", or "our").

2. Eligibility

You must be at least 13 years old to use YearOn! Challenge Planner. By using the App, you represent and warrant that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are under 18, you must have your parent or guardian's permission to use the App.

3. Account Registration and Security

To access certain features, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

4. Subscriptions and Payments

YearOn! offers auto-renewable subscription plans that provide access to premium features.

Subscription Options

• Individual Plan: Monthly or yearly billing
• Duo Plan: Monthly or yearly billing (includes 2 memberships)
• Family Plan: Monthly or yearly billing (includes 6 memberships)

Auto-Renewal

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

Free Trials

If offered, free trials automatically convert to paid subscriptions unless canceled at least 24 hours before the trial ends. Any unused portion of a free trial will be forfeited upon purchasing a subscription.

Managing Your Subscription

You can manage or cancel your subscription at any time through your device settings:

• iOS: Settings → [Your Name] → Subscriptions → YearOn!
• Android: Google Play Store → Menu → Subscriptions → YearOn!

Cancellation takes effect at the end of the current billing period. You will retain access to premium features until that time.

Refunds

Payments are processed by Apple (App Store) or Google (Play Store). Refund requests must be submitted directly to the respective platform according to their refund policies. We cannot process refunds directly.

Price Changes

We may change subscription prices at any time. Price changes will take effect at the start of the next subscription period following notice. Your continued use after a price change constitutes acceptance of the new price.

5. Acceptable Use

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Harass, abuse, or harm other users
• Post inappropriate, offensive, or explicit content
• Spam or send unsolicited messages
• Impersonate others or provide false information
• Attempt to gain unauthorized access to the App or its systems
• Interfere with or disrupt the App's operation
• Use automated systems or bots to access the App
• Violate any applicable laws or regulations

6. User Content

You retain ownership of content you submit ("User Content"), but grant us a worldwide, non-exclusive, royalty-free license to use, store, display, and distribute your User Content in connection with operating the App.

You represent and warrant that your User Content:

• Does not infringe any third-party rights
• Is not defamatory, obscene, or offensive
• Does not contain viruses or malicious code
• Complies with all applicable laws

7. Health Data and Medical Disclaimer

YearOn! Challenge Planner integrates with health tracking services (HealthKit, Google Fit) to track fitness activities. By using these features, you acknowledge that:

• The App is not a medical device
• Information provided is not medical advice
• You should consult healthcare professionals before starting any fitness program
• We are not responsible for the accuracy of health data
• You use fitness tracking features at your own risk

8. Challenges and Activities

When participating in challenges:

• You must report activities honestly and accurately
• Cheating or manipulating results is prohibited
• You participate at your own risk
• We may remove or modify challenges at our discretion
• Challenge data may be visible to other participants

9. Moderation and Enforcement

We reserve the right to:

• Review and remove User Content that violates these Terms
• Suspend or terminate accounts for violations
• Report illegal activities to law enforcement
• Cooperate with legal investigations

Users may report inappropriate content or behavior. We will review reports and take appropriate action. Banned users may appeal by contacting us at [email protected].

10. Intellectual Property

The App and its content (excluding User Content) are owned by Redbud Works LLC and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.

11. Privacy

Your use of the App is subject to our Privacy Policy. By using the App, you consent to the collection and use of your information as described in the Privacy Policy.

12. Disclaimers and Limitation of Liability

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

OUR TOTAL LIABILITY SHALL NOT EXCEED $100 OR THE AMOUNT YOU PAID US IN THE PAST TWELVE MONTHS, WHICHEVER IS GREATER.

13. Indemnification

You agree to indemnify and hold harmless Redbud Works LLC, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.

14. Termination

We may terminate or suspend your access to the App at any time, with or without cause or notice. You may delete your account at any time through the App settings. Upon termination, your right to use the App ceases immediately.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes through the App or email. Your continued use after changes constitutes acceptance of the modified Terms.

16. Governing Law and Disputes

These Terms are governed by the laws of Texas, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Travis County, Texas. You waive any objection to jurisdiction or venue in these courts.

17. Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Redbud Works LLC regarding the use of YearOn! Challenge Planner.
